You must not use such marks without the prior written permission of TrustbotAI. The Shopify name, logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the services are the trademarks of their respective owners.

TrustbotAI is powered by Shopify, which allows us to provide you with the services. However, all sales and purchases you make in our shop are concluded directly with TrustbotAI. By using the services, you acknowledge and agree that Shopify is not responsible for any aspect of the dealings between you and TrustbotAI, including any harm, damage, or loss arising from products and services purchased. You hereby expressly release Shopify and its affiliates from all liability for any claims, damages, and liabilities arising out of or related to your purchases and transactions with TrustbotAI.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the services; (b) reproduce, duplicate, copy, sell, resell, or exploit any portion of the services; (c) collect or track the personal information of others; (d) to engage in any spamming, phishing, pharming, pretexting, spidering, crawling, or scraping; or (e) interfere with or circumvent the security features of the services or any related website, other websites, or the Internet. We reserve the right to suspend, disable, or terminate your account at any time without notice if we determine that you have violated any part of these terms and conditions.

WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL TrustbotAI, OUR AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 16 – INDEMNIFICATION
You agree to indemnify, defend and hold harmless TrustbotAI, Shopify and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any loss, damage, liability, or claim, including reasonable attorneys’ fees, made by any third-party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third-party, or (3) your access to and use of the Services.
We will notify you of any indemnified claims, provided that any failure to promptly notify you will not relieve you from any liability or obligation except to the extent that such failure materially prejudices your defense. We may control the defense and settlement of any such claim at your cost, including the choice of counsel, but will not settle any claim that requires you to pay money or admit liability without your prior consent (which may not be unreasonably withheld). You will cooperate in defending any such indemnified claims, including by providing relevant documents.

You and TrustbotAI consent to the venue and personal jurisdiction of such courts.

It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms, in accordance with applicable law. Such changes will take effect as of the date provided in the notice. Your continued use of or access to our Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 23 - Contract Duration and Termination
All contracts are for an indefinite period and can be terminated at the end of each month. Termination must be submitted in writing via email 5 days before the end of the month.

SECTION 25 – Type of Service (Chatbots & Voicebots)

TrustbotAI does not develop its own chatbot or voicebot systems. All chatbot and voicebot solutions we offer are based on technologies and products from third-party providers, which we configure, implement, and support for you as part of our service.

By purchasing one of our monthly plans, you do not acquire ownership of or rights to the underlying technology, but solely access to a service set up, operated, and maintained by TrustbotAI. The technical infrastructure, functional logic, and system architecture remain the property of the respective third-party providers.

Our service particularly includes:

  • the selection of suitable third-party solutions,

  • the professional setup and adaptation to your business requirements,

  • integration into existing systems,

  • ongoing operation, support, and optimization within the chosen monthly plan,

  • as well as the use of our experience in AI-supported communication processes.

TrustbotAI is not liable for malfunctions, failures, or limitations attributable to third-party systems or services. The terms of use and license conditions of the respective third-party providers also apply, which you agree to by using our services.
